Terms of Service

Please read these Terms & Conditions (“Terms”) carefully before purchasing or participating in the Built to Last programme. By purchasing, accessing or participating in the programme, you confirm that you have read, understood and agree to be bound by these Terms.
1. About Us & These Terms
The Built to Last programme (the “Programme”) is provided by Evan Beales Coaching, including its Built to Last programme and any future name under which the same business operates (for example, Paradox) (“we”, “us”, “our”). These Terms govern your access to and participation in the Programme, including one-to-one coaching, group coaching, and use of our coaching app(s).
If you do not agree to these Terms, you must not purchase or participate in the Programme.
How you accept these Terms. Before you pay, you will be asked to tick boxes confirming that you have read and agree to these Terms and our Privacy Policy. After payment, and before full access is given, you will also be asked to read and sign certain documents electronically (for example, via DocuSign), which may include these Terms, a health questionnaire (PAR-Q) and a disclaimer. By ticking the boxes and/or signing, you enter into a binding agreement with us, and we keep a record of your acceptance.
2. Eligibility
You must be at least 18 years old to purchase or participate in the Programme. By accepting these Terms, you confirm that you are 18 or over and legally able to enter into this agreement.
3. The Programme
The Programme is an educational health, nutrition, fitness and lifestyle coaching programme delivered digitally (including written materials, guides, documents, structured food guidance, resistance-training and movement guidance, food reintroductions, encouragement to reduce or quit smoking and vaping, tracking/check-ins, and group/community support).
The Programme is provided for general educational and informational purposes only. It is not a medical service, and we do not provide medical, clinical, diagnostic or treatment services (see Section 5).
Everything provided in the Programme is offered as guidance and suggestions for you to consider, not instructions or directions you must follow. You remain responsible for deciding what is right for you and for any choices you make.
We may update, change or improve the content of the Programme from time to time.
4. Pilot / Test Programme
The Programme is currently provided as a pilot / test programme. This means the content, structure, materials and delivery are still being developed, refined and tested, and may be changed, updated, paused or withdrawn at any time.
As part of taking part, you may be asked to provide feedback, ratings and check-ins, which help us shape and improve the Programme. You acknowledge that, as an early participant, the Programme may contain errors, gaps, or features that are incomplete or subject to change, and that it is provided on the basis set out in these Terms, including the disclaimers and limitations below.
Use of your information and results. By taking part, you agree that we may use anonymised and aggregated information, such as overall feedback, results and insights that do not identify you, to evaluate, improve and promote the Programme. We will not publish anything that identifies you (for example your name, image, or an identifiable testimonial, story, or before/after photo) without first obtaining your separate, explicit consent. You may decline, and where you give consent, you may withdraw it at any time.
5. Nature of the Guidance, and Health & Medical Disclaimer
(Please Read Carefully)
We are not qualified or registered nutritionists, dietitians, doctors, or other medical or healthcare professionals, and we do not hold ourselves out as such. The Programme is based on personal experience, knowledge and research. We are not your doctor, physician, dietitian or healthcare provider, and no coach–patient or practitioner–patient relationship is created by your participation.
The Programme is guidance, not instruction. Everything we provide is offered as general information and suggestions for you to consider and, where appropriate, to discuss with a qualified professional. It is not professional advice, instruction or direction; you are under no obligation to follow any of it; and you remain solely responsible for your own decisions and actions.
The Programme is not medical advice. The information, materials and guidance provided are for general educational and informational purposes only and are not a substitute for professional medical advice, diagnosis or treatment.
Not psychological or therapeutic treatment. The Programme includes content about habits, mindset, and your relationship with food and your body. This is general educational guidance only. It is not psychological, psychiatric or therapeutic advice or treatment, and it is not a substitute for professional mental health support.
You agree to consult a qualified physician or healthcare professional:
• before starting the Programme or making any change to your diet, nutrition, exercise or lifestyle;
• before acting on any information provided in the Programme; and
• if you experience any adverse symptoms, discomfort, or health concerns at any time during the Programme.
You should seek medical or professional advice in particular, and the Programme may not be suitable for you, if you are pregnant or breastfeeding, are under medical supervision, take prescription medication, have any existing or chronic medical condition, or have (or think you may have) any history of disordered eating, an eating disorder, or any mental health condition.
You participate at your own risk. You are solely responsible for your own health decisions and for evaluating whether any activity, food, or guidance is appropriate for you. If something does not feel right, stop and seek professional advice. In an emergency, contact your local emergency services immediately.
No guarantee of results. Every individual is different. We do not guarantee any specific health, fitness, weight, or other outcome. Any examples, testimonials or results shared are illustrative only and are not a promise or guarantee that you will achieve the same; individual results vary and are not typical.
6. Food, Allergies, Intolerances & Reintroductions
The Programme includes structured nutrition guidance, the removal of certain foods, and the gradual reintroduction and “testing” of foods (for example dairy, caffeine and others) so that you can observe how your body responds.
You are responsible for:
• knowing your own food allergies, intolerances and sensitivities;
• not consuming any food, drink or ingredient that you are, or suspect you may be, allergic or intolerant to;
• reading product labels and ingredient lists, including checking that a product does not contain ingredients you need or wish to avoid; and
• seeking advice from a qualified medical professional before reintroducing or testing any food if you have, or suspect you have, any allergy, intolerance or medical condition.
Reintroductions are optional – you do not need to introduce any food simply because it appears in the Programme. If you experience any allergic reaction or adverse symptoms, stop immediately and seek medical advice; in an emergency, contact your local emergency services.
7. Supplements & Third-Party Products
From time to time the Programme may mention or link to third-party products, including supplements (for example, electrolytes, magnesium, digestive enzymes, collagen), equipment, foods and other items.
These products are made and sold by third parties, not by us. We do not manufacture, control, or guarantee them, and we are not responsible for them. Any supplement or product is optional, is not a substitute for a varied diet or professional medical advice, and should be used in line with the manufacturer’s instructions. You should consult a qualified healthcare professional before taking any supplement, particularly if you are pregnant or breastfeeding, take medication, or have any medical condition.
Affiliate disclosure. Where we provide a link to a third-party product, we may receive a commission or other benefit if you make a purchase, at no additional cost to you. We only suggest products we use, trust or have tested, but any purchase is a matter between you and the third-party seller, on their terms.
8. Alcohol, Caffeine, Smoking & Vaping
Parts of the Programme refer to alcohol and caffeine (for example, navigating social situations or reintroducing caffeine). Nothing in the Programme is intended to encourage you to consume alcohol or caffeine. If you choose to consume either, you do so responsibly, lawfully, and at your own risk, and you should not do so contrary to medical advice or where it would be unsafe for you.
The Programme may also encourage and support you in reducing or quitting smoking or vaping, if that is something you choose to do. This is your choice, and we do not provide stop-smoking treatment. If you take any medication or have a health condition, you should speak to your GP or pharmacist before stopping, as quitting can affect how some medicines work. Free support is available through the NHS stop-smoking service.
9. Pricing & Payment
The price of the Programme is as stated at the point of purchase. Payment is due in full (or in accordance with any payment plan offered) before access is granted, unless otherwise agreed in writing.
You are responsible for any taxes, currency conversion fees, or bank/payment-processor charges that apply to your purchase.
10. Refunds
Refunds are offered at the sole discretion of the coach. Because the Programme provides immediate access to digital content and materials, you are not automatically entitled to a refund once access has been granted.
If you wish to request a refund, please contact us, and we will consider your request on a case-by-case basis. Any refund decision is final and made at our discretion.
Pre-programme requirements. After payment, you will be asked to complete and sign certain documents before full access is granted (for example a health questionnaire (PAR-Q), these Terms, and a disclaimer). If you do not complete these, or if your responses raise a health concern that means we do not consider it appropriate for you to take part, we may decline your participation and provide a refund.
Note for UK consumers: this does not affect any non-excludable statutory rights you may have. Where the Programme is digital content supplied immediately, you may be asked to consent to immediate access and to acknowledge that your statutory cancellation/cooling-off right is lost once access begins.
11. Intellectual Property & Ownership
All content provided as part of the Programme – including but not limited to the written materials, guides, documents, PDFs, videos, audio, images, branding, programme name, programme structure, phases, and methodology (the "Materials") – is owned by us (Evan Beales Coaching, including any future name under which we operate) and is protected by copyright and other intellectual property laws.
Nothing in these Terms transfers any ownership of, or rights in, the Materials to you. All rights not expressly granted are reserved. You are granted a personal, non-exclusive, non-transferable, revocable licence to access and use the Materials solely for your own personal use in completing the Programme. This licence ends automatically if you breach these Terms or when your access to the Programme ends.
12. Confidentiality & No-Copying
The Materials are confidential and provided to you for your own personal use only.
You agree that you will not, at any time during or after the Programme:
• share, send, forward, show or give the Materials (including printouts, downloads, screenshots or recordings) to any other person;
• disclose the specific content, structure, methods or approach of the Programme to any third party; or
• use, or allow anyone else to use, the Materials to create, deliver, copy or develop any other programme, course, plan or service — including any fitness, nutrition, coaching or wellness product, whether for profit or otherwise.
This applies in particular to sharing the Materials with, or disclosing their content to, other coaches, trainers, businesses or competitors. These obligations continue to apply after your participation in the Programme has ended.
Any information shared by other participants within the Programme community (for example in group chats or forums) is also private and must not be shared or disclosed outside the Programme.
13. Participant Conduct
You agree to engage respectfully with other participants and with us. We may remove content and/or suspend or terminate access for any participant who is abusive, disruptive, or who breaches these Terms.
14. Assumption of Risk
You acknowledge that participation in any nutrition, dietary change, food reintroduction, physical activity or exercise carries inherent risks, including the risk of injury, allergic reaction or illness. You voluntarily choose to participate, and you knowingly and freely assume all such risks. To the fullest extent permitted by law, you agree that you participate at your own risk and that we are not liable for any injury, loss or harm arising from your participation, save where it cannot lawfully be excluded.
15. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded.
Subject to that, and to the fullest extent permitted by law:
• the Programme and Materials are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement;
• we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, income, or data; and
• our total aggregate liability arising out of or in connection with the Programme shall not exceed the total amount you paid to us for the Programme.
16. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Evan Beales Coaching, and its owners, employees and contractors, from and against any claims, liabilities, damages, losses and expenses (including legal fees) arising out of or connected with your breach of these Terms, your misuse of the Materials, or your participation in the Programme.
17. Termination & Suspension
We may suspend or terminate your access to the Programme immediately and without refund if you breach these Terms (including the intellectual property and confidentiality terms in Sections 11 and 12). On termination, you must stop using and delete or destroy any copies of the Materials in your possession.
18. Data Protection & Privacy
We process personal data in accordance with applicable data protection law, including the UK GDPR and Data Protection Act 2018, and (where relevant) the EU GDPR for users in the EU/EEA. Any health-related information you choose to share is sensitive personal data, and by sharing it you consent to us processing it for the purpose of delivering the Programme. Full details are set out in our Privacy Policy.
19. International Users (Outside the UK)
The Programme is operated from the United Kingdom. If you access it from outside the UK, you do so on your own initiative and are responsible for complying with any local laws that apply to you. The Programme is not directed at, and these Terms are not tailored to, any specific country other than as stated, and availability of the Programme does not mean it is appropriate or lawful in your location.
20. Additional Terms for Users in the United States
(These are additional US-specific disclosures that sit on top of the main Terms. Have someone familiar with US requirements (FTC, FDA and state privacy laws) check them before use.)
No professional relationship / no medical or healthcare advice. We are not licensed or registered nutritionists, dietitians, physicians or other healthcare providers. Nothing in the Programme constitutes medical, dietetic, psychological or other licensed professional advice, and it is provided as general guidance only. The Programme is not intended to diagnose, treat, cure or prevent any disease or health condition. These statements have not been evaluated by the U.S. Food and Drug Administration (FDA).
Results disclaimer (FTC). Any testimonials or results are individual experiences and are not typical. We make no representation that you will achieve similar results, and you should not expect any specific outcome.
Affiliate disclosure (FTC). Where we recommend or link to third-party products, we may earn a commission. We disclose this in line with U.S. Federal Trade Commission (FTC) guidance. Any statements about such products are the manufacturer's, and we make no independent representation about them.
Release & assumption of risk. To the fullest extent permitted by applicable law, you release Evan Beales Coaching from any and all claims arising from your participation, and you acknowledge the assumption of risk set out in Section 14.
Governing law. As set out in Section 21, these Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. This applies to US users too; we do not require arbitration.
State privacy rights. Residents of certain US states (e.g. California under the CCPA/CPRA) may have specific rights regarding their personal data. See the Privacy Policy for details.
21. Governing Law & Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Programme (including non-contractual disputes or claims), are governed by the laws of England and Wales, wherever in the world you are based. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim. The only exception is that, if you are a consumer, you continue to benefit from any mandatory consumer-protection rights of your country of residence that cannot lawfully be excluded.
22. Changes to These Terms
We may update these Terms from time to time. The version in force is the one published at the time of your purchase or participation. Continued participation after changes are published constitutes acceptance of the updated Terms.
23. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any term is not a waiver of that term.
